Generally, copyrighted materials can be used under a fair use exemption if it is for teaching, research, reporting, criticism, comment, or scholarship. There are four factors to consider before using a copyrighted item under the fair use exemption

  • purpose and character of the use
  • nature of the copyrighted material
  • amount and substantiality of the portion being used
  • effect on the value of the copyrighted work
